The Property Ombudsman
What is The Property Ombudsman — and why does it matter?
If you have been researching cash buyers, estate agents, or property auction companies, you may have seen a dark blue logo featuring a white triangle and the words The Property Ombudsman.
The logo shows that a company is a registered member of The Property Ombudsman (TPO) scheme — an independent, government-approved redress service designed to resolve disputes between consumers and property professionals.
It is always important to check that a company is genuinely registered rather than simply displaying the logo. If you are considering using a “sell house fast” service, here is what you need to know.
Who is The Property Ombudsman?
Established in 1990, The Property Ombudsman is a not-for-profit organisation that provides independent dispute resolution across the UK property sector. Its role is to:
- Offer impartial complaint resolution
- Protect consumers
- Provide an alternative to costly court proceedings
The scheme operates independently from the property industry and is overseen by a board of non-executive directors, including an independent chairperson. This structure is designed to ensure fairness, transparency, and unbiased decision-making.
While TPO is government-approved, it is not a regulator and cannot issue fines or take legal action. However, it can award compensation of up to £25,000 where a complaint is upheld. TPO covers estate agents, letting agents, and professional cash house buyers — providing protection across the wider property market.
How does it benefit you?
Choosing a property company that is a member of The Property Ombudsman provides an additional layer of security and reassurance.
1. Independent dispute resolution
If a disagreement arises — whether about valuation, offer terms, or conduct during the sale — TPO offers an impartial complaints process. This can help resolve disputes without the need for expensive legal action.
Before escalating to TPO, a company must follow its own internal complaints procedure. If that does not resolve the issue, the Ombudsman can review the case independently.
2. Fair treatment
TPO members must follow a strict Code of Practice that prioritises:
- Honesty
- Transparency
- Fair dealing
- Clear communication
This is particularly important in fast property sales, where sellers may feel pressure because of financial difficulty, divorce, inherited property, or repossession.
Members must not use high-pressure tactics, mislead sellers, exploit vulnerable individuals, or manipulate offers unfairly. If a seller is in a vulnerable situation, additional care must be taken to ensure they fully understand the process and are not rushed into decisions.
3. Protection against misleading offers
TPO members must clearly explain:
- How the property valuation is calculated
- The basis of any offer made
- Timescales for completion
- Any conditions attached to the sale
They cannot reduce an agreed offer without a valid reason, such as significant findings in a survey. This helps protect sellers from unfair last-minute price reductions (often referred to as gazundering).
4. Transparency on fees and terms
All costs, fees, and terms of business must be clearly explained upfront. This means:
- No hidden charges
- No undisclosed conditions
- No unexpected deductions at completion
Everything should be communicated in plain English so sellers can make informed decisions.
5. Confidentiality and data protection
Members must handle personal and financial information responsibly and confidentially. Your data should only be used for the purpose of progressing your property sale.
6. Compensation awards
If a complaint is upheld, The Property Ombudsman can award compensation of up to £25,000. Although larger awards are uncommon, compensation can cover financial loss or hardship resulting from a company’s actions.
How to check if a company is a member
Before working with any estate agent or cash buyer, you can verify their membership directly through The Property Ombudsman’s official website. This ensures the company is genuinely registered and bound by the Code of Practice.
